Final brief filed Mayfield injunction case: Jeremy Mayfield’s legal team has filed its final reply brief in arguing against NASCAR’s request that U.S. District Court Judge Graham Mullen, in light of a disputed July 6 drug test, reconsider his injunction that lifted Mayfield’s suspension centering around his May 1 drug test. NASCAR suspended Mayfield for a May 1 drug test that it says showed a positive result for methamphetamines. Mayfield claims the test resulted in a false positive reading created by the prescription drug Adderall, which is used to treat attention-deficit hyperactivity disorder, and the allergy medication Claritin-D. Mayfield obtained an injunction from Mullen on July 1 to keep NASCAR from enforcing the initial suspension. Since then, NASCAR has gotten that injunction put on hold – leaving Mayfield suspended – by the U.S. Court of Appeals until the appeals court can hear arguments on the matter, a process that likely will last until at least October. Mayfield’s filing Tuesday mainly focuses on the legal precedent on why Mullen should not rescinded the injunction. Mayfield’s lawyers also argue that NASCAR expert Mace Beckson contradicts NASCAR’s contention that Mayfield poses a danger to fans since Beckson indicates that no absolute conclusion about a person’s medical condition can be based solely on a drug test. There is no deadline for Mullen to rule on NASCAR’s request to have the injunction rescinded.(SceneDaily)(8-20-2009)

Three-time NASCAR Sprint Cup champion Jimmie Johnson had the gas to get to the White House on Wednesday, where President Barack Obama honored the 2008 winner as well as auto racing. “NASCAR is a uniquely American sport,” Obama said beneath the South Portico, flanked by most of the 12 drivers who competed last year for NASCAR’s top prize. Joining Johnson at the White House were other Sprint Cup drivers and past champions. Special guests included wounded soldiers from Walter Reed Army Medical Center in Washington and campers from the Victory Junction Gang Camp in Randleman, N.C., which NASCAR supports. Johnson’s #48 Chevy also was parked on the White House driveway, with the glittery Sprint Cup perched on a table nearby.(Associated Press)(8-20-2009)
Smith may have full-time ride in 2010; with a sponsor? UPDATE: Regan Smith, the 2008 Sprint Cup rookie of the year, has agreed in principal to drive the #78 car for Furniture Row Racing in 2010, sources close to the situation said on Saturday. Smith is driving a part-time schedule for the Colorado-based team this season, but tentative plans are to run a full schedule next year. Smith was left without a fulltime ride after his Dale Earnhardt Inc. team was shut down due to lack of sponsorship following 2008. He has competed in 11 races this season for Furniture Row, with a top finish of 12th at the July 4 race at Daytona.(ESPN)
AND At the recent gathering of Farm Bureau PR and Communications professionals in Denver, CO, Furniture Row Racing, unveiled a new NASCAR paint concept to support and bring awareness to the ag industry as a whole; The Car of the Heartland&Official Car of the American Farmer. The people at Furniture Row Racing know and understand the hard work and devotion that ag producers across the country have made to their industry and their way of life. Furniture Row is making a substantial financial commitment to promote that hard work and devotion and to try and put American agriculture back on the radar screen of consumers across the country. The attendees of the unveiling were moved and excited by the new car. Julie Murphy, Communications Director for Arizona Farm Bureau was brought to tears by the car and what it represents. “As a producer, I am just so grateful,” she said. The Car of the Heartland represents a revolutionary change in NASCAR, one not seen in 60 years of the sport. Traditionally, car designs have been a mish-mash of logos and brands, confusing fans and diluting effectiveness. Furniture Row understands that what individual cars need is a focused message, one that fans can follow, and they are leading the way with their new Car of the Heartland. Going forward, Furniture Row needs help from Farm Bureau in the promotion of the Car of the Heartland. They need Farm Bureau members to talk to their friends and acquaintances and help tell the story of the car and promote the message of American agriculture. Colorado Farm Bureau will do its part to help promote the car and raise awareness with the public. Other industry groups are on board to help promote that car as well. If all goes according to plan, the car should run in 36 races next season.(Colorado Farm Bureau), no comment from team about this news.(8-16-2009)
UPDATE: Furniture Row Racing announced that it will run the full 36-race NASCAR Sprint Cup schedule in 2010. The race team also announced that Regan Smith will continue to drive the #78 Chevy next season. The decision to return to a full-time schedule was based on the positive effect the race team along with NASCAR’s popularity have had on the Furniture Row Companies marketing and advertising programs. The race team, which ran a full schedule in 2006, 2007 and 2008, also stated that it will continue to search for additional sponsorship partners, in the form of primary or associate to help with costs and possibly grow the race team. The #78 Furniture Row team was originally scheduled to compete in 12 races in 2009. Four additional races have been added to the schedule, including Saturday night’s race at Bristol (Tenn.) Motor Speedway. According to Garone, there is a good possibility of adding more races.(Furniture Row Racing PR)(8-19-2009)
BlackJack Racing and Dexter Bean have decided to withdraw from the Sharpie 500 after the news of crew chief, Ryan Bergenty, breaking his ankle in three places on Tuesday night at Bristol Motor Speedway. Bergenty went to Bristol earlier than the rest of the team, on Tuesday, August 18, 2009 to take in all the racing festivities. As he hopped out of a motor coach, Bergenty’s ankle rolled and he was suddenly in severe pain. Bergenty was then taken by ambulance to the Wellmont Bristol Regional Medical Center, where he is scheduled to have surgery this afternoon. Depending on Bergenty’s progress, the next race for Bean could be the Sylvania 300 at the New Hampshire Motor Speedway, on September 20, 2009.(BlackJack Racing)(8-19-2009)
Crew Chief change at the #19 UPDATE 2: Sirius NASCAR Radio’s Sirius Speedway is reporting Tuesday that Kevin Buskirk is out as crew chief of Elliott Sadler’s #19 Dodge at Richard Petty Motorsports, and will be replaced on an interim basis by Wally Rogers.(8-18-2009)
UPDATE: This weekend Elliott Sadler visits the Tennessee half-mile with a new face on his pitbox. Wally Rogers, the team’s car chief, will serve as the interim crew chief for the Richard Petty Motorsports entry. Rogers, a multi-time winner as a crew chief in the Nationwide series, replaces Kevin Buskirk who will be reassigned to other duties within the Petty team.(RPM)(8-18-2009)
UPDATE 2: Elliott Sadler was on SIRIUS NASCAR Radio Tuesday with host Dave Moody and talked about the change:
Elliott Sadler: “Wally Rogers, who had been my car chief all season long, his and my communication has been very good and he makes a lot of decisions that we make during the race weekend and we decided to put him on the pit box and be the crew chief this weekend and I think it’s going to work out good for us. We just saw the #43 and #44 makes some changes over at RPM and I think everybody is looking for that special chemistry that you can have between driver and crew chief to make your cars run better each and every week. We have 13 races left to go in this season and we’re looking for that spark to try to make our team just a little bit better and something to build on for next year.”(Sirius Radio)(8-19-2009)

Kyle Busch Back In Victory Lane At Bristol
It had been 16 races across NASCAR’s top three series since Kyle Busch had made it to Victory Lane.
He made sure that streak wasn’t going to stretch any further Wednesday night in his return to the Camping World Truck Series.
Busch took control of the 200-lap race at Bristol Wednesday night, passing Jason White on Lap 124 and never looking back in winning by over two seconds on the half-mile oval.
“I’ve really taken to the new surface,” Busch said. “We knew we were coming here with a fast truck, and luckily we were able to capitalize on it tonight.”
Matt Crafton came home second, followed by Ron Hornaday, Jr., Ryan Newman, and Brian Scott. For Hornaday, his streak of winning five straight Truck Series races came to an end with a truck that started third but was never able to lead a single lap.
“I’m sort of glad it’s over so I can quit talking about it and go racing again,” Hornaday said, who at 51 set a record for the oldest man to win that many races in a row in NASCAR’s top three series. “It’s been a great ride.”
Aric Almirola, David Starr, T.J. Bell, Stacy Compton, and Timothy Peters rounded out the top 10 finishers. Hornaday’s lead in the championship standings now stands at 211 over Matt Crafton.
Earlier in the evening, Donny Lia made a late pass of Teddy Christopher, then held on to win the 150-lap Modified race that featured Cup drivers Ryan Newman and Kasey Kahne (both of whom failed to finish).
Johnny Benson Visits Truck Series Garage
2008 Truck Series champion Johnny Benson was at Bristol Wednesday, attending a race for the first time since a devastating accident at Berlin Speedway. Suffering multiple injuries in a supermodified race there June 13th, Benson has been out of a car ever since as he continues to recover from the broken rib, wrist, and shoulder injuries that will keep him from climbing behind the wheel until at least November.
Despite the physical problems, Benson was remarkably upbeat as he visited with drivers, crews, and other members of the garage while eyeing a return to the sport in 2010.
“We gotta do something about Ron [Hornaday] winning all these races,” he joked on SPEED. “Hopefully, I’ll be able to do something about that soon.”
The veteran has talked to several Nationwide and Truck Series teams about next season, but nothing has been signed as of yet.

Kyle Busch Returns To Victory Lane At Bristol
08-19-2009 | TruckSeries.com Report
Kyle Busch won the O’Reilly 200, his 12th victory in 63 NASCAR Camping World Truck Series races. This is his third victory and eighth top-10 finish in 2009. Busch has also found success at Bristol in the past with his second victory and fourth top-10 finish in five races. Matt Crafton finished second and posted his third top-10 finish in seven races at Bristol. This also broke Ron Hornaday Jr.’s streak as he came in third. J.R. Fitzpatrick was the highest finishing rookie coming in eleventh. Now Ron Hornaday Jr. leads the point standings by 211 points over Matt Crafton.

RON HORNADAY, NO. 33 GEORGIA BOOT SILVERADO, FINISHED 3RD: “I told Kevin (Harvick) a top-five here tonight would be great here. We have such bad luck here. We run good, we just have bad luck. Rick Ren made a great call on our only stop for this Georgia Boot Chevrolet. It was cool. I learned a bunch. Kyle (Busch was just so dominate up top. He had his truck free enough at the beginning and I learned that and then when he pitted and then came right back in for fuel, that is what hurt us right there. We lost so much track position right there. It was my own fault, I should have been paying attention, I was following the guy in front of me.
“Overall, winning five in a row. I have to thank of these fans and everything that has been written. It has been a lot of fun. We will just start all over again.”
RON, YOU KNEW THAT THE STREAK HAD TO END AT SOME POINT. “I did and you know, Bristol is one of the toughest ones here. I found something out with ten to go and I don’t know. I just left a lot out there and I was pretty conservative and I got a top-five and that’s what I needed for these points and I have to thank Georgia Boots, Longhorn, VFW, Miller Welders, and everybody that has been really supportive of our team. It’s been pretty cool and I hope these fans enjoyed the race and we were coming through the pack there and I should have followed Kyle down there and got fuel but I didn’t, and that’s what hurt us right there.”
RYAN NEWMAN, NO. 2 PRINGLES SILVERADO, FINISHED 4th: “Well, I felt like I or we let the guys down. We didn’t come back in and get our fuel and lost a lot of track position on that deal and just never got it back. We had a fast truck with this Pringles Chevrolet, but just lost or track position and just never got it back. Ultimately it’s my fault. I just didn’t know I was supposed to come back in for the fuel deal, just not used to it. Guess you can call it a rookie mistake.”
KEVIN HARVICK, KEVIN HARVICK INC. THREE TRUCKS IN TONIGHT’S RACE – RON HORNADAY, RYAN NEWMAN, J.R. FITZPATRICK: FIVE CONSECUTIVE VICTORIES BUT THIRD TONIGHT, ARE YOU LOOKING FOR A REPLACEMENT? “No. (Laughs) It is just incredible to see the roll that these guys have gone on. The whole team and Ron, Rick (Ren, crew chief) and everybody at the shop being a part of it. These guys on the No. 4 and the No. 33 put each other’s trucks together. They put the No. 2 truck together with the Nationwide crew. It is fun to see everybody work together and winning races. You just don’t ever know when you are going to win the next one let alone five in a row, but a good night all around for Georgia Boot and Pringles and the Fitzpatricks. Two trucks in the top-five and three trucks in the top-11, Hard to complain. This has been one of our worst tracks for whatever reason as far as performance and to have two trucks in the top-five is a huge accomplishment.

ARCA RE/MAX Series Heads for Home Turf; Toledo Speedway Coming Fri, Sept 4; University of Toledo Marching Band to Perform in Pre-Race Festivities……..
TOLEDO OH (8-17-09) – In between events on a 1.5-mile superspeedway and a mile dirt track, the versatile ARCA RE/MAX Series will turn its attention to its home turf at the Toledo Speedway short-track Friday night, September 4 for the ARCA RE/MAX 200 presented by Federated and Belle Tire, the 66th appearance of the hometown touring series at Toledo since 1963.
Nine time series champion and nine time Toledo winner Frank Kimmel will have his hands full with race-ready rookies, including Penske Development driver Parker Kligerman, who won at Toledo back in May. The victory for Kligerman set off a trend during which the 19-year-old Westport, Connecticut rookie won four consecutive races at Michigan Int’l Speedway, Mansfield Motorsports Park, Iowa Speedway and Kentucky Speedway.
Justin Lofton, who owns the one-lap track record at Toledo (15.860 seconds/113.493 mph), finished second to Kligerman at Toledo in May and snapped Kligerman’s four-race win-streak with back-to-back wins of his own at Berlin Raceway and Pocono Raceway.
Other entrants include Kligerman’s teammate Dakoda Armstrong, who has just signed on as a Penske Development driver, and Greenville, North Carolina rookie Craig Goess. Goess is currently battling Miami Springs, Florida rookie Joey Coulter for Rookie of the Year honors. Goess and Coulter are currently fourth and fifth in championship points behind Kligerman, Lofton and Kimmel.
Ken Butler III is also planning a Toledo Speedway return. The Lilburn, Georgia driver won his one and only ARCA RE/MAX Series race at Toledo in May of 2007 after bumping his teammate Michael McDowell out of the way in the closing laps.
In addition to Kimmel and Butler, former Toledo winners include Justin Allgaier, Ken Schrader, McDowell, Bill Venturini, Ramo Stott, Iggy Katona and Jack Bowsher.
Kimmel, who is just five wins shy of tying Katona’s all-time win mark of 79, hasn’t won at Toledo since September of 2005.
In addition, the University of Toledo Marching Band will be performing on the frontstretch during pre-race festivities, which also includes an hour-long, on-track autograph session with the stars and cars of the ARCA RE/MAX Series.
ARCA RE/MAX Series practice is scheduled from 2:00 to 3:30 PM Friday, September 4 followed by Menards Pole Qualifying presented by Ansell at 5:00 PM. The ARCA RE/MAX 200 presented by Federated and Belle Tire is scheduled to start at 8:30 PM under the lights. The event will also feature live streaming video and audio of all the on-track activity at ARCAracing.com.
Toledo Speedway is located at 5639 Benore Rd., Toledo OH, near the intersection of I-75 and Alexis Road. For more information, please call ARCA at (734) 847-6726, or Toledo Speedway at (419) 727-1100.
