Mayfield meth suspension on hold for now; team not present at Daytona

A federal judge ruled in Jeremy Mayfield’s favor Wednesday, granting the suspended driver a temporary injunction uplifting his suspension from NASCAR. Mayfield was seeking a restraining order against NASCAR to overturn the suspension and NASCAR delayed a legal decision on the matter, by having the case moved to a federal court.

In the U.S. District Court, senior Judge Graham Mullen said that the case has done more to harm Mayfield than it has NASCAR.

Mayfield Cannot Find Ride for Coke Zero 400

On Wednesday, the big news story in NASCAR was that Jeremy Mayfield had received an injunction from a Federal judge which allowed him to attempt to qualify for this weekend’s Coke Zero 400 at Daytona International Speedway. However, there are some problems with that ruling.

First off, since the ruling came down on Wednesday and the cutoff to get to Daytona with a team and sign into the garage was Thursday afternoon at 3pm, Mayfield realized that he did not have enough time to get his own No. 41 Toyota down to Daytona from North Carolina. However, Mayfield did have a trump card that he could play. Mayfield requested permission from Gunselman Motorsports to drive their No. 64 Toyota at Daytona. Team owner Larry Gunselman may have been somewhat receptive to the offer, but according to ESPN’s Sportscenter, one-race sponsor Fred’s Hometown Discount Stores objected to the move, citing that they did not want to be involved with Mayfield.

Furthermore, ESPN reported on Thursday that Mayfield had requested the right to drive for no less than four teams this weekend at Daytona, only to be turned down by all four. The reasoning given was similar to the reason that Fred’s gave: They didn’t want to be associated with Mayfield.

Ragan Turns Quickest Lap of Sprint Cup Practice, and Nationwide Happy Hour at Daytona

David Ragan turned the fastest average speed during the first practice session for Saturday night’s Coke Zero 400 at Daytona International Speedway in his No. 6 UPS Ford with a lap of 190.714mph (47.05 secs).

Behind Ragan was the No. 07 of Casey Mears, the No. 26 of Jamie McMurray, the No. 20 of Joey Logano, and the No. 83 of Brian Vickers.

Ragan’s lap was turned at the very beginning of the practice session in a multi-car draft. As a result, the speeds turned in are not a real indication of speed for single-car qualifying to be held Friday afternoon.

Regan Smith, who timed in 34th, was the fastest of the “Go or Go Home” teams, followed by Brad Keselowski, Scott Speed, and Joe Nemechek. The two slowest teams, and thus, the teams most in danger of failing to qualify are the No. 64 of Mike Wallace and the No. 37 of Tony Raines.

Hall Nominees Announced
The National Association for Stock Car Auto Racing (NASCAR) announced today a history-rich list of 25 nominees for the inaugural NASCAR Hall of Fame induction class. From that list, five inductees will be chosen via a process that includes a nationwide fan vote on NASCAR.COM; the inductees will be announced in October and honored next May at the new Hall of Fame facility in Charlotte, N.C. –The nominees, which include many of the sport’s legendary names, were selected by a 21-person nominating committee consisting of representatives from NASCAR, the NASCAR Hall of Fame and track owners from both major facilities and historic short tracks. “This first list of potential inductees is impressive, to say the least,” said NASCAR Chairman and CEO Brian France. “Now comes the hard part — choosing only five to be inducted. Every single person on this list is worthy to be in the NASCAR Hall of Fame.” — The HOF’s first inductees will be determined by the Voting Panel, which has 50 members — the entire Nominating Committee, 14 media members, four manufacturer representatives and nine retired competitors (drivers, owners, crew chiefs — three each) and two recognized industry leaders. In addition, the fan vote will result in the Voting Panel’s 51st and final ballot. Following are the 25 individuals who have been nominated:

Mayfield Won’t Make Daytona
Despite winning a court injunction that allows him to race this weekend at Daytona, Jeremy Mayfield won’t be in the Coke Zero 400 on Saturday night. He missed the deadline to enter. And that’s not all that big a surprise. Mayfield is already strapped for cash and is being sued for money owed by his Cup team. Putting together a car and crew in such a short time would have been difficult at best. His other option was to drive for someone else, but apparently nobody else is interested. NASCAR plans no immediate changes to drug policy: NASCAR does not plan any immediate changes to its substance-abuse policy in light of Jeremy Mayfield’s victory in obtaining a preliminary injunction forcing NASCAR to lift his suspension for an alleged positive drug test for methamphetamines, NASCAR spokesman Ramsey Poston said Thursday. Part of Mayfield’s case questions the guidelines that NASCAR must follow in its drug-testing policy. Mayfield argues that NASCAR must follow the guidelines for federal agencies; NASCAR contends that it does not have to do so. NASCAR will continue with its random drug-testing policy, which it implemented this year, during this weekend’s events at Daytona International Speedway just as it has done all year, Poston said. Poston said he is not aware of any challenges from any crew members suspended this year under the policy, and he did not think the ruling would prompt challenges.(SceneDaily)(7-3-2009)

NASCAR changes drug testing process: #9-Kasey Kahne says NASCAR has stepped up its drug testing procedure since the suspension of Jeremy Mayfield. Kahne said the tests he took prior to the suspension were “in and out” in five to 10 minutes. He said his most recent test two weeks ago at Infineon Raceway took nearly 40 minutes. “It’s a process now,” Kahne said on Thursday at Daytona. “Every little step you have to sign your name or initial, work with the person that is taking the sample. To me that’s because of the whole Mayfield incident, to clarify everything and make sure the driver and also the person taking the sample is on the same page.” NASCAR’s procedure was under attack when attorneys were seeking a temporary injunction to get Mayfield’s suspension lifted, which it was on Wednesday by a federal judge in Charlotte, N.C. Attorneys for Mayfield questioned whether Mayfield saw the seal put on his “A” and “B” samples. Kahne said he always has watched the collector put on the seal, but that the process wasn’t so detailed before. #42-Juan Pablo Montoya, who was tested at Dover in early June, said there is a lot more paperwork now. “I did it at Daytona [in February] and it was a little easier,” he said. “[At Dover] it was like proof of who you are. I’m like, ‘I’m a freaking racer.’ ” Three-time defending Cup champion #48-Jimmie Johnson has not been tested since Mayfield’s suspension, but said he’s had to wait on other drivers who were and it’s taken longer. He noted at Sonoma Kahne held up things because he had to go get his driver’s license, something that he didn’t understand to be required previously.(ESPN.com)(7-3-2009)

NASCAR questions Mayfield’s urgency to get back to track: NASCAR spokesman Ramsey Poston said Jeremy Mayfield’s absence from the track Friday called into question the argument his attorneys used in requesting a preliminary injunction on NASCAR’s drug suspension. Here’s what Poston said: “Jeremy and his legal team asked for a preliminary injunction for emergency relief because it was necessary apparently to come and compete here in Daytona. Apparently he’s not here and it appears as if he’s not going to compete this weekend which would raise some questions on how much of an emergency it really was.”(Orlando Sentinel)(7-3-2009)

Latest on Red Bull to Chevy: Red Bull Racing [#82 & #83] will decide in a month whether to switch from Toyota to General Motors in 2010, sources close to the situation said. There has been speculation for a month that Red Bull would move to Chevys with the chassis and engines supplied by Hendrick Motorsports. HMS owner Rick Hendrick has said he needs to pick up some additional business to make up for the financial support GM cut after it filed for bankruptcy last month. Red Bull general manager Jay Frye, who has worked with HMS in the past, said Thursday at Daytona International Speedway, that no decision has been made. Richard Petty Motorsports could leave Dodge and fill Red Bull’s vacancy if there is one. Robbie Loomis, the vice president for race operations at RPM, said the organization continues talking to all manufacturers about next season.(ESPN Insider)(7-3-2009)

Burger King sponsorship of Stewart kicks off at Daytona: Saturday Burger King Corp. will officially kick-off the company’s sponsorship of Tony Stewart and Stewart-Haas Racing at Daytona International Speedway with the debut of the #14 Burger King Chevy. Burger King Corp. is teaming with TNT for the “Wide Open” race coverage of the Coke Zero 400 – allowing fans fewer interruptions during the race. BKC will feature two :60 ads in the lower third quadrant of the screen starring the King and Tony Stewart. This weekend also marks the first time race fans will have the opportunity to purchase Burger King branded Tony Stewart merchandise. The BKC/Stewart-Haas Racing sponsorship agreement, which was announced in January of this year, includes two primary paint schemes on the #14 Sprint Cup car, including this weekend at Daytona and for the September 27th race at Dover. WHAT IS YOUR REACTION TO THE NEWS ABOUT JEREMY MAYFIELD? WHAT DID YOU THINK WHEN YOU HEARD THE NEWS AND HOW COMFORTABLE WILL YOU BE WITH HIM ON THE RACE TRACK?:
“I think it’s important to understand what the ruling is — I think once the ruling was made, there’s been a lot of jumping to conclusions that what the judge said was that NASCAR’s wrong, end of story. That’s not the case at all. What the judge said was, or the way I viewed it, was that it is in question, the result can be questioned, but the judge did not say the result was wrong. The judge said it could be questioned and while it’s being questioned, what do we do about it. The way I view it is that if and when he comes back NASCAR has every right to test him as many times as they would like to make sure that things are being done correctly and there’s no drug problem on the race track. The only problem with that is that it’s not an instant test.

“One thing that I disagree with the judge on is that my safety is important to me and if there’s an instant test available then I think the judge’s opinion is 100 percent right. There is no instant test available. At the same time, from Jeremy’s (Mayfield) perspective, if the judge ruled that it can be questioned then it should be questioned and he should have the ability to look into it. If that’s what the court’s ruled. It’s a tough situation for anybody to make that decision because he potentially puts my safety in jeopardy with that decision. The other decision potentially puts Jeremy’s (Mayfield) career in jeopardy so what do you do. That’s almost not a right answer.

“Sometimes you can make an answer, but neither one is 100 percent right and that’s kind of the way I view it. The next step is going to be a really big step when the case continues. I am obviously not an attorney, but I don’t know if there’s going to be appeals, but ultimately, unless there is some agreement prior to that, it will eventually go to trial and that decision of that trial will be huge. I would love to have an instant test for anyone that’s in question. At the same time, the ultimate question could be the court system and if the court system says, ‘Hey, maybe we should look at it,’ then I’m okay with looking at it.”

MARK, EVERY DRIVER SO FAR TODAY HAS BEEN ASKED ABOUT JEREMY MAYFIELD AND HIS SITUATION. IT SEEMS AS IF IT’S AN UNCOMFORTABLE QUESTION FOR A DRIVER TO ANSWER. DO YOU FEEL UNCOMFORTABLE?
“I’m comfortable with being on the racetrack with Jeremy Mayfield. One-hundred percent.

I feel that NASCAR needs to have the authority to say whether or not that you drive. I don’t know anything about judges. I don’t know anything about laws and I don’t know anything about anything else, but I do believe that NASCAR needs to have the authority to make that call. And they need to be responsible with it and careful with it. I think that somebody is wrong. Either Jeremy or NASCAR is wrong, and I don’t know which one, but whichever one is wrong is really hurting the other. I don’t know. That is about all my thoughts on that matter.”

IT SOUNDS LIKE YOU THINK JEREMY IS RIGHT IF YOU FEEL COMFORTABLE RACING WITH HIM. DO YOU HAVE A REASON TO FEEL THAT WAY?
“I’m just not concerned with being on the racetrack with Jeremy. None whatsoever. I’m not concerned with that. I feel one-hundred percent confident being on the racetrack side-by-side with Jeremy. That doesn’t mean that he didn’t fail. I don’t know what happened. Okay? I’m just saying that if he races, I have no problem.

“I do however have a problem with NASCAR not being able to say you can’t. That is a problem for our sport. They need to be the authority. They need to be able to say if you do or if you don’t. They need to be responsible with it, and careful with it, but they need to have the say.”

HOW DO YOU FEEL ABOUT POSSIBLY BEING BACK ON THE RACE TRACK WITH JEREMY MAYFIELD?: “I never said that I didn’t want to be on the track with Jeremy Mayfield. When all that comes out then I will be happy to answer that, but at this point right now, I signed something saying that I would not want to be on the track with somebody that tested positive or that positively had drugs in their system. I don’t think there’s anybody in this garage area that wouldn’t feel that way. I didn’t have any issues with Jeremy (Mayfield) on the track prior to all this going on and I don’t think that would change if he was out on the track anytime soon.”

HOW DO YOU FEEL ABOUT THE JUDGE’S RULING MEANING HE COULD BE BACK ON THE TRACK BUT NOT WHETHER THE TEST WAS POSITIVE OR NOT?: “I have no idea — I am so confused right now at the whole thing that I am going to let it all play out. I’ll be honest, I haven’t been following it enough to know what’s going on. Leave me out. I support NASCAR in what they’re wanting to do and what they’re trying to do with the drug policy. I think it’s the right thing to do and I support that 100 percent.”

CAN YOU COMMENT ON THE PROSPECTS OF WHEN JEREMY MAYFIELD DOES RETURN? “I’ve read a couple of small things. I couldn’t tell you exactly whose articles I read. The bottom line is I don’t quite understand some of it. I will say that some people that don’t understand motorsports, some people that don’t understand sports in general and the situation that we had when somebody tests positive is something to be seriously considered and there is a lot of responsibility that goes along with that. As a federal judge when you release somebody to go back and do that without necessarily in my eyes clarifying everything that’s not cool. People make mistakes. I just hope the judge didn’t make one.”

ARE YOU OKAY WITH RACING WITH JEREMY MAYFIELD RACING ON THE SAME RACETRACK AS YOU IF THAT IS THE WAY IT WORKS OUT?
“I’m pretty sure that whenever he comes back to race, he will be tested. And if at that point, whoever it is, if they are sober and they pass the test then put them on the track. If not then they don’t need to be on the track and that is what this whole thing boils down to.

It’s hard to know exactly what is going on in this thing and it’s been confusing and difficult to follow but at the end of the day we all wanted a drug policy and we have one and now we are living by it. We just want everybody that is on track to not be under the influence and that is the bottom line.

I am confident that when he does come back to the track that he comes back to that he will be taking a test, and at that point everyone should be breathing easily.

“I like NASCAR’s drug policy. I like what they’ve done there. I’ve been tested a few times this year and early in the year, I would go and get tested and it was kind of in and out. Ragan fastest in Happy Hour: #6-David Ragan was fastest in happy hour with a speed of 182.626mph. #87-Joe Nemechek was second, followed by #40-Scott Wimmer, #99-Michael Waltrip, #20-Joey Logano, #33-Kevin Harvick, #60-Carl Edwards, #15-Michael Annett, #23-Robert Richardson, and #12-Justin Allgaier. Just 39 drivers participated in the session. Slowest were #07-Justin Ashburn and #58-Mike Harmon. The session ended about 5 minutes early because of rain showers. There was one accident in practice when #66-Wallace got into the rear of #11-Lagasse, spinning him into #37-Raines. Lagasse will have to go to a backup.

Waltrip fastest in opening practice: #99-Michael Waltrip was fastest in the first practice session at Daytona with a top speed of 185.491mph. #62-Brendan Gaughan was second, followed by #33-Kevin Harvick, #05-Jeff Green, #29-Clint Bowyer, #5-Dale Earnhardt, Jr., #88-Brad Keselowski, #15-Michael Annett, #6-David Ragan, and #16-Matt Kenseth. Slowest were #07-Justin Ashburn and #91-Terry Cook. #58-Mike Harmon had no speed. There were 2 cautions during the session – 1 for debris and 1 for oil on the track.

The Milwaukee Mile office is closed, and all 12 staff members have been laid off at least temporarily. Whether the oldest auto racing facility in the country lives to see its 107th birthday is in grave doubt even among its biggest boosters. “It depends totally if I’m able to get some investors,” promoter Claude Napier said Thursday in a telephone interview from Texas. Napier, president and chief executive officer of Wisconsin Motorsports, admitted to the Journal Sentinel for the first time that he had no other financial backers when he entered into a deal in February with State Fair Park, where the track is located. “I’ve got a hunch it’s over,” said Dominic Giuffre, a former promoter with his brother Frank. “It’s too late.” The Giuffres, promoters at the Mile from 1983-’91, have expressed interest in returning to that role. It is “very uncommon” for NASCAR to stage a race without being paid in advance by the promoter, said Ramsey Poston, a NASCAR spokesman. The races were already scheduled and television contracts in place when Napier took over. Given its dealings this year, NASCAR is not expected to grant credit to the track – no matter who operates it – to return for 2010.(Milwaukee Journal Sentinel)(7-2-2009)

Gerhart attempting second race of season: 5-time ARCA Daytona 200 winner Bobby Gerhart will return to the site of his greatest successes, Daytona International Speedway, when he competes in the NASCAR Nationwide Series Subway Jalapeno 250 powered by Coca-Cola on July 3rd. Gerhart will drive the Bob Schacht Motorsports #75 Chevy with support from long-time sponsor, Lucas Oil. This will be the second Nationwide race of the season for the Gerhart – Schacht combination. Their first outing was at Talladega in April. Bobby had moved up to 8th place with 4 laps to go but was relegated to a 33rd place finish after getting collected when #12-Justin Allgaier spun.(Gerhart PR)(7-2-2009)

White enters World Series of Poker: Jason White, Driver of the #23 Gunbroker.com Dodge, will cash in his position as a driver in the NASCAR Camping World Truck Series and enter the World Series of Poker. White will be the first-ever NASCAR Driver to participate in the 13-day event that begins on July 3rd at the Rio Hotel and Casino in Las Vegas, Nevada. White will be in search of the first place prize at the end of the event which includes high payouts and the coveted World Series of Poker bracelet. Holiday Plans Anyone? Gerhart’s Going to The Beach
DAYTONA BEACH FL (7-2/3-09) – Some folks are headed to the closest grill for a holiday BBQ this July 4th holiday weekend, while others are heading to the beach. Five-time Daytona ARCA 200 winner Bobby Gerhart has definitely opted for “The Beach” – Daytona Beach to be more specific. As it turns out, Gerhart has dusted off his NASCAR Nationwide Series car for the running of the Subway Jalapeno 250 powered by Coca-Cola Friday night.
